This offer is available until further notice by Costa (the "Promoter") to Costa Club members who are GB residents, over 16 years of age and who have registered to use the Costa Club app (the "App"). All participants will be deemed to have accepted these terms and conditions in full. These terms and conditions should be read, where applicable, together with the Costa Club terms and conditions (the "Costa Club Terms") which can be found here.

  1. Registered members of the Costa Club who have downloaded the App (each a potential "Referrer") can invite a friend ("Recipient") to download the App and join the Costa Club by following the on-screen instructions at the “invite your friends to the app” section of the App. The App will create a unique invitation ("Invite or Invitation") which can be sent to a Recipient by the Referrer. The Invitation contains a link to the App and a unique invitation code for the Recipient. Please note that both a Recipient and a Referrer must have a mobile device with an internet connection which is capable of downloading the App in order to participate.

  2. Before the Referrer invites a friend to join the Club as part of any promotion operated by us, please only do so with their prior consent. Don’t spam them. The Referrer must ask for the Recipients’ consent before forwarding any invitation or Club access link to them.

  3. A Recipient must download the App via the link in the Invitation and (provided they comply with the requirements of the Costa Club Terms) sign up to become a member of the Costa Club.

  4. In order for both the Recipient and the Referrer to receive the benefits set out at paragraph 4 below, the Recipient must:
    a) have consented to receive the invitation from the Referrer
    b) follow the link provided in the Invitation to download the App;
    c) as part of registering for the Costa Club on the App, provide the unique invitation code from the Invitation at the appropriate part of the sign-up process; and
    d) make a bean earning purchase in accordance with the Costa Club Terms. For the avoidance of doubt, this means the Recipient needs to make a purchase of:
    (i) a handcrafted drink (i.e. any handcrafted drink which is on the menu board at a Costa outlet) from a participating Costa outlet in Great Britain;
    (ii) a bundle deal drink (i.e. any drink which is included in any bundle deal) from a participating Costa outlet in Great Britain;
    (iii) a drink from a Costa Express machine in Great Britain; or
    (iv) any drinks purchased at (i) to (iii) above (inclusive) via Click & Collect and/or Contactless Ordering (see Contactless Ordering and Click & Collect sections of the Costa Club Terms),
    and scan or otherwise use the App when making any purchase referred to at (i) to (iv) above (inclusive) ("Qualifying Purchase").

  5. If the Recipient complies with all of the requirements of paragraph 3 above, both the Recipient and the Referrer will have five (5) beans added to their Costa Club account within 48 hours of the Recipient making a Qualifying Purchase. Costa Club beans are issued strictly in accordance with the Costa Club Terms.

  6. There is no limit to the number of Recipients a Referrer can invite to download the App and register for the Costa Club. However, each Recipient must comply with the Costa Club Terms. For the avoidance of doubt, each person you invite must be a GB resident over 16 years of age and must not already be a member of the Costa Club. Please note that the Costa Club Terms provide that an individual may only register one membership.

  7. No cash alternative. Costa Club beans are non-transferable and cannot be resold.

  8. The Promoter processes your personal data in connection with the offer for the purposes of administering and managing the offer. This processing is in order to fulfil a contract or take steps linked to a contract (and if it is not provided, you may not be able to enter into, or the Promoter may not be able to fulfil, the contract). Additional information about the purposes for which the Promoter processes personal data, how it is processed and data protection rights (including the right to object in circumstances) are set out in the Promoter’s Privacy Policy, a copy of which can be found here.

  9. The Promoter reserves the right to withdraw or amend the terms of this offer at any time. Notice of the withdrawal of the offer or the amendment of its terms will be posted on the App. The withdrawal or amendment of the offer will not affect Referrers or Recipients who have already earned beans in accordance with the terms of the offer before the offer is withdrawn or amended.

  10. The Promoter also reserves the right to withdraw, alter or suspend the offer at any time with or without notice if circumstances beyond its control make this unavoidable.

  11. The Promoter reserves the right at any time, in its absolute discretion to: (i) verify the eligibility of: (a) any Referrer; and (b) each Recipient (including their age and place of residence); and (ii) to disqualify any person found to be abusing or tampering with the operation of the offer or endeavouring to earn beans using fraudulent means including (but not limited to) by: (a) a Recipient registering on the App more than once; (b) a Referrer sharing a unique code to more than one Recipient (via posting the unique code on a website, public forum, public social platforms or on the Costa Club page, for example). Please note however that there is no limit to the number of Recipients a Referrer can invite to download the App and register for the Costa Club, but a Referrer should generate a new unique code for each Recipient; or (c) who the Promoter otherwise believes to have acted in breach of these terms and conditions or the Costa Club Terms.

  12. If the Promoter fails to comply with these terms and conditions, the promoter is responsible for loss or damage you suffer that is a foreseeable result of the Promoter's breach of these terms and conditions or its negligence, but it is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of the promoter's breach or if they were contemplated by you and the promoter at the time that you entered the offer.

  13. Save where required by law, the Promoter accepts no responsibility or liability for any failure to comply with these terms and conditions for reasons beyond its control and accepts no responsibility or liability for any attempt to register with or to log-in the App which is unsuccessful or incomplete for technical or other reasons beyond its control.

  14. The offer and these terms and conditions, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with English law and you can bring legal proceedings in respect of the offer and these terms and conditions in the English courts. If you live in Scotland you can bring legal proceedings in respect of the offer and these terms and conditions in either the Scottish or the English courts.

  1. Under the Costa Club Membership terms, when you earn eight (8) beans you will receive a ‘Free Drink’ voucher. You are now entitled to share that voucher, if you wish, with a friend through the Costa Club app ‘Gift a Reward’ functionality.

  2. You must be a member of the Costa Club and have the Costa Club app to be able to share the voucher with a friend.

  3. There is no maximum amount of vouchers you are able to share with a friend, however you will only be permitted to share five (5) vouchers with a friend at any one time through the Costa Club app. If you wish to share more, you will need to access the Costa Club app an additional time to make this transfer.

  4. You will be able to share the voucher via social media direct message channels, email or instant messaging.

  5. If you share a voucher with a friend, it will be removed from your Costa Club app once it has been accepted by your friend, and you shall not be entitled to also use that voucher. If you use the voucher prior to it being accepted by your friend in the Costa Club app, your friend will no longer receive the voucher. If you share one voucher with multiple friends, the first friend to enter the code on their Costa Club app will redeem that voucher and it will become unavailable to any others you have shared it with.

  6. If you receive a notification that a friend has shared a voucher with you and you are:
    a) not a Costa Club member, to redeem the voucher, you will be required to: (i) download the Costa Club app; and (b) register as a member of the Costa Club; or
    b) a Costa Club member, the voucher will automatically appear as a ‘Free Drink’ in the rewards section on the Costa Club app.

  7. Once a voucher has been shared with you, you can choose to redeem the voucher or you can transfer the voucher to any other person in accordance with these terms and conditions.

  8. The voucher: (a) cannot be used more than once; (b) is only valid for six months from the date the voucher was issued by Costa; and (c) can only be redeemed against handcrafted drinks purchased in-store at participating Costa outlets.

  10. The promoter reserves the right to amend, suspend or withdraw the promotion at any time without prior notice if circumstances beyond its control make this unavoidable.

  11. The promoter shall not be liable for any failure to comply with these terms and conditions as a consequence of events beyond its reasonable control.

1. INTRODUCTION

1.1 By entering the promotion all participants will be deemed to have accepted these terms and conditions in full. All entry instructions form part of these terms and conditions.

1.2 The promotion is open to Costa Club members who are residents of Great Britain aged 18 or over at the date on which they enter the promotion, except for employees of Costa, its group companies, agents or anyone professionally connected with this promotion and any member of their respective immediate families.

1.3 Entry to the promotion opens at 00:01am on Thursday 5th May 2022 and closes at 23:59pm on Wednesday 15th June 2022 (the "Promotion Period"). Entries received after the Promotion Period will not be eligible to win a prize.

2. ENTRY TO THE PROMOTION

2.1 To enter the promotion scan your Costa Club App when you make a purchase (with a minimum spend of £1) during the Promotion Period: (a) using Costa Collect; (b) at a participating Costa Coffee store (c) using a Costa Express machine; and (d) using Costa Delivery in Great Britain (each a “Costa Channel” and together the “Costa Channels”). Then tap on the Coffee Shot tile icon that will appear in your Costa Club App after your qualifying purchase and will be available for 72 hours before expiring.

2.2 When participants make one purchase through a Costa Channel and follow the steps in paragraph 2.1 above, this will provide one entry into the promotion. There is a maximum of seven (7) entries per Costa Channel per day into the promotion.

2.3 Purchases made with Costa Club Beans will not be eligible for this promotion.

2.4 Purchases made using a Costa Coffee gift card will be eligible for this promotion provided there is a minimum spend of £1. 

3. WINNERS

3.1 A minimum number of 2,000,000 winners will be selected at random from all eligible entries by a randomised computer programme subject to paragraph 3.2 below.

3.2 The number of Prizes awarded depends on the number of entrants during the Promotion Period as the Prizes are awarded randomly based on a minimum of 1 in 4 transactions (so if there are 8,460,000 qualifying entrants all Prizes will be awarded, but if there are less than 8,460,00 qualifying entrants not all Prizes will be awarded).

3.3 Winners will be notified immediately in the Costa Club App when you tap the Coffee Shot tile icon and (depending on the prize) will be contacted via email with details of how to claim your prize.

4. THE PRIZES

4.1 There is a total of 2,065,844 prizes available to be won however this depends on the number of entrants as per paragraph 3.2 above.

5. CONDITIONS

5.1 You must be using the latest version of the Costa Club App to enter the Promotion.

5.2 For prizes set out in paragraph 4.2 (save for any Costa Club Beans or digital vouchers) Costa will send an email to the winner within 3 days of the relevant draw notifying them of their prize.

5.3 Within 3 days of receipt of the email from Costa notifying winners of their prize, winners must then ensure that their address details linked to their Costa Club account on the website (www.costa.co.uk/coffee-club/login) are correct. If address details have not been entered within 3 days of receipt of the email, Costa reserves the right to award the prize to an alternative winner selected at random.

5.4 All bonus Costa Club Beans and digital vouchers will be added to the relevant account within 48 hours from winning the prize.

5.5 Prizes to be delivered will be delivered within 28 working days from a valid acceptance of the prize.

5.6 No cash alternative. Prizes are non-transferable and cannot be resold or swapped (unless permitted to do so by Costa). Costa reserves the right to substitute an alternative prize of equal or greater value. Unless otherwise agreed in writing by Costa, the prize will only be awarded to the winner. Certain prizes are subject to the terms and conditions of the third party provider of the prize, as communicated to the prize winner by the relevant third party.

5.7 Each winner agrees to take part in reasonable publicity as may be required by Costa in respect of the promotion.

5.8 Insurance, Maintenance, Services and running costs of the vehicle are the responsibility of the Car winner from the date of ownership.

5.9 No entries from agents, third parties, syndicated entries or those made using methods such as a computer macro, script or the use of automated devices are permitted and no bulk entries.

5.10 All costs and expenses not included within the prizes are the responsibility of the winner(s).

5.11 Costa reserves the right at any time, in its absolute discretion, to:
a) verify the eligibility of any participant (including their age and place of residence);
b) disqualify any participant found to be abusing or tampering with the operation of the promotion or entering using fraudulent means, or who Costa believes to have acted in breach of these terms and conditions; and
c) disqualify participants who do not give correct contact details or those who make an entry on someone else's behalf.

6. LIABILITY

6.1 Subject to clause 6.2, if Costa fails to comply with these terms and conditions, Costa will be responsible for loss or damage participants suffer that is a foreseeable result of Costa’s breach of these terms and conditions. Costa is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of the promoter's breach or if they were contemplated by you and the promoter at the time that you entered the Promotion.

6.2 Costa shall not be liable for: (i) any failure to comply with these terms and conditions as a consequence of events beyond its reasonable control including without limitation, any failure of communication networks and any closure of participating Costa stores or interruption in supplies as a consequence of Covid-19 or of any other circumstances beyond the reasonable control of Costa; and/or (ii) any loss of profits, loss of revenue or other economic loss or any indirect or consequential loss.

6.3 Except as otherwise required by applicable law, Costa accepts no responsibility or liability for any entry or claim which for technical or other reasons is unsuccessful, incomplete, lost, late, damaged, corrupted or misdirected.

7. GENERAL

7.1 Any decision of Costa in respect of the promotion is final. For questions regarding the promotion, get in touch here.

7.2 Costa reserves the right to extend, withdraw, alter or suspend the prizes or these terms and conditions at any time if circumstances beyond its control make this unavoidable.

7.3 Any images are an illustrative example and do not show the exact prize(s).

7.4 All personal data submitted in connection with the Promotion will be processed by Costa for the purposes of administering and managing the Promotion and prizes (where applicable) and verifying the eligibility of each participant. Costa is committed to protecting the privacy of all participants. Data that is collected from or about participants will be used in accordance with Costa’s Privacy Policy (which also includes information about the data rights of participants), a copy of which can be found at www.costa.co.uk/privacy-policy.

7.5 By entering the promotion each participant gives Costa permission to publish their surname and county of residence if they are a winner of one of the prizes unless the participant notifies Costa that they do not wish us to make these details available. Please note that Costa will nonetheless be required to provide the names of all prize winners to the Advertising Standard Authority if requested to do so.

7.6 The promotion and these terms and conditions, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with English law and you can bring legal proceedings in respect of the promotion and these terms and conditions in the English courts. If you live in Scotland you will also benefit from any mandatory provisions of Scottish law and can bring legal proceedings in respect of the promotion and these terms and conditions in either the Scottish or the English courts.

  1. The prize is for a seven-night Norwegian Fjords cruise for two people on-board P&O Cruises’ Iona ship, sharing a balcony cabin on G314 departing from Southampton (UK) on 13 May 2023 (the “Prize”). The provider of the Prize is Carnival plc trading as P&O Cruises with its registered office being Carnival House, 100 Harbour Parade, Southampton, Hampshire, United Kingdom, SO15 1ST (“P&O Cruises”).

  2. Prize includes accommodation as above, on board main meals (excluding specialty restaurants in which a cover charge will apply), entertainment and most facilities on board. Prize does not include transport to or from the winner and their guests’ home and Southampton, travel insurance (adequate insurance is a condition of travel), drinks, excursions, luggage fees or other personal expenses incurred.

  3. Prize is non-transferrable, non-exchangable and no cash alternative will be offered. The winner’s booking with P&O Cruises of the Prize must be confirmed by [DATE].

  4. The winner and their guest will be bound by P&O Cruises booking terms and conditions which can be found at pocruises.com/legal-and-privacy and must have a full valid passport (with validity 6 months). The winner and their guest must meet all relevant travel requirements and obtain any necessary vaccinations and visas for their trip.

  5. Should the prize become unavailable, a substitute of equal value shall be provided by P&O Cruises. P&O Cruises reserves the right to replace the Prize with an alternative prize of equal or higher value if circumstances beyond P&O Cruises’ control makes it necessary to do so, including but not limited to, the cancellation of the cruise in accordance with government guidelines.

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry/claim instructions are deemed to form part of the terms and conditions and by participating all entrants will be deemed to have accepted and be bound by the terms and conditions. 4. Entry Instructions:

e. You will be emailed a link to verify your email address. Once the email is verified you will have been successfully entered into the promotion.
f. Please retain receipt as proof of purchase. This must clearly indicate the purchase, date, time and outlet.
g. Without proof of purchase, claims cannot be verified and will be void.

5. Qualifying products:
- The qualifying products for the prize promotion are:

(a) Any Costa beverage served at a Costa Coffee Ireland outlet.
(b) Any Costa beverage served at a Proud to Serve outlet.

6. Participants must have a mobile phone or tablet device with an enabled camera to enter by scanning the QR code. Participants must have access to an internet connection via a WIFI connection or cellular connection. Website is open 24 hours until 23:59 on the closing date. Ask the bill payer before accessing internet connection. If you enter after the closing date, you will not be entered. Take care when entering details; the Promoter is not responsible for mistypes. If you are unable to access the website, please check with your network operator first. The Promoter does not accept responsibility for entries or claims that are delayed or not received due to transmission, network connection or software problems or any other reason beyond the Promoter’s control.

7. Entry is by scanning the QR code only. Only one entry per purchase transaction during the promotional period (1 entry, 1 purchase receipt and 1 entry reply = 1 entry). For the avoidance of doubt only one unique name, address, mobile number and email address will be accepted and can only be used by one person. It cannot be shared within a household. A receipt cannot be shared amongst entrants. Any entrant(s) using multiple name, address, mobile number and email address sharing receipts to enter the promotion will be disqualified and any prize made void. The Promoter reserves the right to determine, in its sole and absolute discretion, whether a participant or household has already submitted an entry and to disqualify any subsequent entries or prize entitlement.

8. No third party or bulk entries. Entries via third parties, consumer groups or syndicates, entries by macros or other automated means and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified. If it becomes apparent that either a participant or household is using any means to circumvent this condition such as, and without limitation, fraudulently falsifying data; using multiple mobile phone numbers; using multiple postal addresses; acting fraudulently or dishonestly in the opinion of the Promoter; using identities other than their own; creating fake identities or using any other automated or manual means in order to increase that participant's or a household’s entries or otherwise acting in violation of these terms, the participants and their household will be disqualified, and any prize entitlement will be void.

9. Proof of purchase will not be accepted as proof of entry. No responsibility can be accepted for entries that are incomplete, lost due to technical reasons, corrupted, delayed or not received for whatsoever reason.

Payment will be made in GBP via a BACS transfer (electronic payment system) by an approved 3rd party supplier. Payment will take minimum 3 days to clear.
10.6 Following delivery the Promoter/Supplier is not liable for quality issues or product lifecycle limitations that may arise from any prize.

11. Winner Selection: The winners will be drawn using a random number generator within 28 working days of the closing date.

12. Winner Notification: The winners will be notified within 28 working days of the closing date. It is the responsibility of the participant to ensure that they respond to the winner notification, by emailing the address provided at the point of notification. If a winner does not respond within the initial 14 days, an alternative winner will be drawn at random. The Promoter cannot be held responsible for the winners failing to supply accurate information which affects prize acceptance or delivery of their prize.

13. Delivery of prizes: The relevant prize will be: (a) sent to the winner’s home address (if a physical prize); (b) sent to the winner’s email address (if an eGift Card); or (c) transferred into the winner’s bank account (if a cash prize), within [30] days of confirming their address details to the Promoter.

14. General: The entry instructions form part of the terms. By entering, you agree to accept and be bound by the terms.

15. The Promoter’s decision is final and binding. No correspondence will be entered into.

16. The prize must be accepted as offered by the named winner. There is no cash or alternative prize, in whole or part. The prize is not transferable. Sale of the prize for profit is prohibited and may constitute fraud.

17. The Supplier reserves the right to provide alternative prizes of equal or greater value should circumstances outside its control make this necessary.

18. The Promoter reserves the right to verify the winners and ask for proof of purchase, identity, age and address and to withdraw prize entitlement where there are reasonable grounds to believe there has been a breach of these terms and conditions.

19. The Promoter reserves the right, at its sole discretion, to eliminate or disqualify any entries or entrants that it regards as being in breach of these terms and conditions or the spirit of the Promotion. Those who try and circumvent the entry process and/or entry instructions by any method, will be disqualified and any prize award will be void.

20. Entry into the Promotion is at the entrant's sole risk. To the extent permitted by law, the Promoter does not accept any responsibility for any damage, loss, liabilities, injury, costs, expenses or claims (whether in contract, tort or otherwise) suffered by entrants or any third parties arising out of or in connection with the Promotion and/or accepting a prize. The Promoter further disclaims liability for any injury or damage to entrants or any other person relating to or resulting from participation with this Promotion save that nothing in these terms and conditions shall act to limit or exclude the Promoter's liability resulting from its negligence or fraud.

21. The Promoter accepts no responsibility for system errors or other issues that may result in disruption to, lost, delayed or not received entries, winner notifications or prizes. The Promoter or its agencies will not be responsible for the non-inclusion of entries as a result of technical failures or otherwise, including any such failure which is within the control of The Promoter or its agencies.

22. The Promoter reserves the right to cancel, amend, withdraw, terminate or temporarily suspend this Promotion in the event of any unforeseen circumstances or technical reason outside its reasonable control, with no liability to any entrants or third parties but will use all reasonable endeavours to avoid consumer disappointment. Such circumstances include, but are not limited to: industrial action, civil unrest, fire, flood, storms, earthquakes, acts of terrorism, acts of war, governmental action or any other event that is beyond the control of the Promoter. The Supplier bears sole responsibility for supply of the prize and cannot be held responsible for any claims relating to the prizes.

23. The application and interpretation of these terms and conditions shall be governed by the law of England and the courts of England and Wales shall have exclusive jurisdiction in relation to any dispute concerning them.

24. Winners’ names and counties will be available within 3 months of the closing date by sending a stamped, self-addressed envelope to Costa Coffee Ireland & PTS Promotion, Mesh Marketing Limited, 3 Evolution, Wynyard Business Park, TS22 5TB. If winners wish to object to their name and county being made available in the winners list, they must inform the Promoter when they are contacted by the Promoter and/or its agents to redeem their prize. 25. Your data will be passed onto a third-party fulfilment service provider for the purposes of administering the prize. The Terms and Conditions for the Costa Coffee BURT Reusable Cup Scheme (the "Scheme") and the End User Licence Agreement for the website application (the "App") are set out below (together the "Agreement").

When you register to use the App and sign up to the Scheme, you enter into a contract with Costa Limited, Costa House, Houghton Hall Business Park, Porz Avenue, Houghton Regis, Dunstable, Bedfordshire, LU5 5YG ("Costa", "we" or "us"). This contract confirms that, in return for being given access to the App and the Scheme, you will access and use the App, the Scheme and the information available through the App, strictly in accordance with the terms of the Agreement.

Costa Coffee BURT Reusable Cup Scheme - Terms and Conditions

These Terms and Conditions and the End User Licence Agreement (together the "Agreement"), apply to your membership of the Costa Coffee BURT Reusable Cup Scheme ("Scheme") and your use of the Costa Coffee BURT Reusable Cup Scheme website application available at www.costaburt.com ("App").

The Agreement governs the relationship between Costa Limited, a company incorporated in England with company number 01270695 whose registered office is at Costa Limited, Costa House, Houghton Hall Business Park, Porz Avenue, Houghton Regis, Dunstable, Bedfordshire, LU5 5YG ("Costa", "we" or "us") and you in respect of your membership of the Scheme. Use by you of the App and Scheme will constitute acceptance by you of this Agreement. This Agreement overrides any statements on the App if they are different. You must therefore read it carefully. Please print a copy of this Agreement for your records. If there is anything you do not understand, please reach out to our Customer Services team by submitting a query through our contact form which can be found here.

Becoming a member and activating your Reusable Cup

You can become a member of the Scheme by registering an account on the App (your "Account"). Your use of the App is subject at all times to the End User Licence Agreement for the App, which is available here.

Once you have registered an Account, you must activate a reusable Costa coffee cup ("Reusable Cup") via the App and pay a fee of £5 using your credit or debit card ("Participation Fee"). This will then enable you to receive either a 12oz or 16oz Reusable Cup (subject to availability) when purchasing any Costa drink in a participating Costa outlet in Great Britain. Your membership of the Scheme can only be registered in the name of an individual and you can only register one membership per email address.

Participating in the Scheme

Once you have registered your Account, activated your Reusable Cup via the App and paid the Participation Fee, you will be entitled to receive a Reusable Cup provided you have completed the following steps:

(i) you will need to request a Reusable Cup from a participating Costa outlet when purchasing a Costa drink; and
(ii) once you have received your Reusable Cup from the relevant participating Costa outlet, you will need to scan (i) the QR Code on the Reusable Cup; and (ii) the participating Costa outlet's QR Code to link the Reusable Cup to your Account.

If you are already in receipt of a Reusable Cup, you will receive a replacement Reusable Cup provided you have completed the following steps:

(i) you must scan (i) the QR Code on the Reusable Cup that you want to return; and
(ii) the participating Costa outlet's QR Code to remove the Reusable Cup from your Account
(ii) return the Reusable Cup to the relevant participating Costa outlet; and
(iii) once you have received a replacement Reusable Cup from the relevant participating Costa outlet, you will need to scan (i) the QR Code on the replacement Reusable Cup; and (ii) the participating Costa outlet's QR Code to link the replacement Reusable Cup to your account.

Expiry and Cancellation

The Scheme ends on the 29 March 2022 at which your membership shall expire. On expiry of your membership you can either keep or return the Reusable Cup to a participating Costa outlet. You will not receive a refund of your Participation Fee on expiry of your membership.

You can claim a refund of your Participation Fee within 28 days of payment being taken (the "Refund Period"). If you request a refund in the Refund Period, you will still be a member of the Scheme but you will not have an active Reusable Cup associated with your Account. You will need to return the Reusable Cup you a participating Costa outlet before a refund can be made. After the Refund Period has elapsed, you can no longer claim a refund of your Participation Fee.

You may forfeit your Participation Fee if you are in the Refund Period, and/or we may suspend your Account if you are in breach of this Agreement, if we have reasonable grounds to suspect that you are engaged in fraudulent or other criminal activities relating to us or the App, or if you supply false or misleading information to us.

Changes to your details

If you need to change any of the details you provided when you registered, please either:

(i) update your details through the App; or
(ii) reach out to our Customer Services team by submitting a query through our contact form which can be found here.

Loss, theft, damage

If your Reusable Cup is damaged or stolen we will only replace your Reusable Cup on payment of an additional Participation Fee. Circumstances in which we may determine, in our sole discretion, that we will not replace your Reusable Cup include where we reasonably believe that the notified incident has been caused by your breach of this Agreement or if there are reasonable grounds for suspecting that you are or have been engaged in fraudulent or other unlawful conduct in relation to your membership.

If your Reusable Cup is faulty we may, in our sole discretion, replace your Reusable Cup at no extra charge. In order to receive a replacement Reusable Cup, please return the faulty Reusable Cup to a participating Costa outlet.

Data protection and privacy

While registering to become a member through the App, you will be asked to provide certain personal information, including your name, address and contact details. We are committed to maintaining the security of your personal information in accordance with the requirements of relevant Data Protection laws and will take all reasonable steps to ensure that your personal data is kept secure against unauthorised access, loss, disclosure or destruction.

Our Privacy Policy will apply whenever you provide us with personal information.

Liability of Costa

If Costa fails to comply with this Agreement, it is responsible for loss or damage you suffer that is a foreseeable result of its breach or of its negligence. Costa is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if was an obvious consequence of Costa's breach or if it was contemplated by Costa and you at the time that you became a member of the Scheme and agreed to be bound by this Agreement.

Costa shall not be held liable for any default resulting directly or indirectly from any cause beyond our control, including but not limited to, failure of network services and failure of data processing systems.

Your rights as a consumer

As a consumer you have legal rights in relation to goods that are not of a satisfactory quality or fit for purpose and services not carried out with reasonable care and skill. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards Office. Nothing in this Agreement will affect these legal rights.

Variation

We reserve the right to amend or waive any provision of this Agreement from time to time and at any time, or to terminate the Scheme (and therefore your membership of the Scheme) on reasonable notice. You should check this page of the App from time to time to take note of any changes we make, as they are binding on you from the date that we make them.

Assignment

We may transfer the benefit of this Agreement to any other company in the same group of companies as Costa. If we assign the benefit of this Agreement, your rights will not be affected.

Governing law and jurisdiction

This Agreement is governed by English law. Any proceedings in relation to this Agreement (whether contractual or non-contractual) shall be subject to the exclusive jurisdiction of the English courts, save that if you are resident in either Scotland or Northern Ireland, we will bring proceedings in the Scottish or Northern Irish courts (as applicable) and you may bring proceedings in either the Scottish or Northern Irish courts (as applicable) or the English courts.

Language and filing

This Agreement is only available in the English language, and we will not file any copy of this Agreement.

1. Who can enter:

  • 1.1 The promotion is open to residents of England, Scotland and Wales who are aged 18 or over when they enter the promotion, excluding employees of Costa Coffee and its subcontractors, subsidiaries and anyone professionally connected with the promotion and their immediate families.

2. How to enter:

  • 2.1 There is no purchase necessary to enter the promotion. To enter the promotion you must provide feedback on your store visit by visiting feedbacktocosta.co.uk and following the instructions. Once your feedback has been received (including your contact details, where requested) you will automatically be entered into the promotion.

  • 2.2 Your data will be used only by Costa for the purposes of administering the promotion and by Clarabridge for the collection of feedback responses.

  • 2.3 Text messages will be charged at your standard network rate and your mobile number will not be disclosed to any third parties for marketing purposes.

  • 2.4 Only one entry per person per month is allowed; multiple entries from individuals will not be permitted.

  • 2.5 The promotional period will run from 00:00 on 03 January 2021 until 23:59 on 31 December 2021.

3. Selection and prize details:

  • 3.1 On or before the first Friday of each month following the month in respect of which entries are received, a winner will be drawn at random by computer for the preceding month. Each winner will be notified that they have won by email within two weeks of the relevant draw. There will be two winners every month.

  • 3.2 Each winner will a £50 amazon voucher.

  • 3.3 There is no cash or other alternative prize available, except that in the event of circumstances outside of its control the promoter reserves the right to provide a similar alternative prize of equal or greater value. 4. Other terms:

These terms tell you the rules for accessing the WiFi service that we make available to you as a visitor to a Costa store.

1. Agreeing to these terms

1.1 By accessing the Wifi service, you confirm that you accept these terms. If you do not agree to these terms, you must not access the Wifi service. We may amend these terms from time to time, so you should check these terms regularly to ensure you understand which terms apply.

2. Suspending or withdrawing your access to the WiFi service

2.1 We give you access to the WiFi service free of charge.

2.2 We do not guarantee that the WiFi service will always be available or that it will be uninterrupted, nor do we guarantee that it will be totally secure or free from bugs or viruses. Access to the WiFi service is permitted on an "as is" and "as available" basis. We may suspend or withdraw or restrict your access to the WiFi service at any time and for any reason (including for business and operational reasons). We will try to give you reasonable notice of any suspension or withdrawal, but we are not obliged to do so.

3. Our responsibility for loss or damage suffered by you

3.1 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

3.2 Please note that we only provide access to the WiFi service for domestic and private use. You agree not to access or use the WiFi service for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of revenue, loss of business, business interruption, or loss of business opportunity.

3.3 We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time that you accessed the WiFi service.

4. Your use of the Wifi Service

4.1 You agree not to:
4.1.1 use the WiFi service in any way that breaches these terms or any applicable local, national or international law or regulation;
4.1.2 re-sell any part of the WiFi service; or
4.1.3 do any act or thing that might damage, disrupt or otherwise interfere with the operation of the WiFi service or any equipment, network or software used in operating the WiFi service.

4.2 You must not use the WiFi Services to participate in any of the following activities:
4.2.1 posting or sending messages substantially similar in content to 10 or more Usenet or other newsgroups, forums, listservs, or other similar groups or lists (each a "List");
4.2.2 posting or sending messages, articles, or other content to a List which are off-topic according to the charter or other owner-published FAQs or descriptions of the List;
4.2.3 sending unsolicited commercial messages or communications in any form;
4.2.4 falsifying user or other Wifi service related information, including, but not limited to, intentionally omitting, deleting, forging or misrepresenting transmission information, including headers, return mailing and Internet protocol addresses or engaging in any activities or actions intended to withhold your identity or contact information;
4.2.5 guessing passwords or accessing systems or networks without written authorisation;
4.2.6 configuring your computer systems to bypass security controls, including the installation of programs or services that allow the systems to be managed or accessed insecurely or through unauthorized means;
4.2.7 gaining, or attempting to gain, unauthorized access to any persons networking, security, management, backup, storage or monitoring systems;
4.2.8 installing programs or configuring systems to allow the monitoring, or “sniffing,” of data traveling over a shared network;
4.2.9 accessing, or attempting to access, security-relevant information, such as password files that may, among other things, be used to gain unauthorized access to system accounts;
4.2.10 installing or using software for the purpose of cracking encrypted data, including stored passwords; or
4.2.11 removing or disabling security software or services, including anti-virus software, logging utilities or authentication services.

4.3 If you supply/upload any content using the WiFi service – whether it be pictures, text, sound recordings or otherwise – the content you supply ("User Generated Content") must comply with the following rules:
4.3.1 it must not be obscene, abusive, offensive or racist and it must not promote or propose hatred or physical harm against anyone;
4.3.2 it must not harass or bully another person;
4.3.3 it must be true and honest so far as you know;
4.3.4 it must not be defamatory of anyone;
4.3.5 it must not use the material or content or infringe the rights or privacy of anyone else; for example you should not use images of well-known characters, footage or music (unless it is your own);
4.3.6 it must not contain someone else’s personal details or confidential information relating to other people; and
4.3.7 it must not promote or condone terrorism, violence or illegal behaviour.

4.4 You must not misuse the WiFi service by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the WiFi service, the server on which the WiFi service is stored or any server, computer or database connected to the WiFi service. You must not attack the WiFi service via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them.

4.5 If you breach the terms set out above, your right to use the WiFi service will cease immediately.

5. Your responsibility for loss or damage suffered by us

5.1 You will fully compensate us against all losses, costs, proceedings, damages, expenses (including reasonable legal costs and expenses) or liability that we may suffer as a result of your use of the WiFi service.

6. Other important terms

6.1 Each of the clauses of these terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining clauses will remain in full force and effect.

6.2 If we fail to insist that you perform any of your obligations under these terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

7. Which country's laws apply to any disputes?

7.1 These terms are governed by the laws of England and Wales. This means that your access to the WiFi service, and any dispute or claim arising out of or in connection therewith (including non-contractual disputes or claims), will be governed by English law.

7.2 You can bring proceedings in respect of these terms in the English courts. However, as a consumer, if you live in another European Union member state you can bring legal proceedings in respect of these terms in either the English courts or the courts of that Member State.

8. How we use your personal data

8.1 Any personal data that Costa collects as part of your use of the WiFi service at a Costa Store.

8.2 This may include the ID number of your device and location data sent from the device you use to access the WiFi service. We will use this personal data in accordance with Costa’s privacy policy.
