Share your views on Costa Express - Terms & Conditions

1. INTRODUCTION

1.1. By entering this free prize draw, all participants will be deemed to have accepted these terms and conditions in full. All entry instructions form part of these terms and conditions.

1.2 The promoter is Costa Limited (company no 01270695) whose registered office is at 3 Knaves Beech Business Centre, Davies Way, Loudwater, High Wycombe, Buckinghamshire HP10 9QR ("Costa").

1.3 This promotion is open to Costa Club App members who have opted-in to receive marketing emails from Costa and who are residents of Great Britain aged 16 or over at the date on which they enter the promotion (“Eligible Member(s)”). Costa Club members who use a card and employees of Costa, its group companies, agents, or anyone professionally connected with this promotion and any member of their respective immediate families will not be eligible to enter this promotion.

1.4 This promotion commences on 12 April 2024 and these terms and conditions will apply each time Costa issues a “Share your views on Costa Club” survey (“Survey”) via email to Eligible Members.

2. ENTRY TO THE PROMOTION

2.1 There is no purchase necessary to enter this promotion. To enter this promotion, an Eligible Member must:

2.1.1 click the link to the Survey received via email from Costa and follow the on-screen instructions; and

2.1.2 fully complete that Survey, and submit their responses, before 23:59 on the Survey closing date/deadline stated in Costa’s email (19 April 2024). If a Survey Closing Date is not stated in Costa’s email, the Survey Closing Date will be 7 days from the date the initial email containing the link to that Survey is sent by Costa.

2.2 If an Eligible Member submits their responses to a Survey after 23:59 on the applicable Survey Closing Date, they will not be entered into this promotion or be eligible to win a prize.

2.3 An Eligible Member must have an internet connection to participate in this promotion.

2.4 One entry per Eligible Member only, multiple entries from an individual in respect of a Survey will not be made or counted. Anyone trying to circumvent this rule by using alternative details including but not limited to creating multiple Costa Club App loyalty accounts will be disqualified from this promotion.

3. THE PRIZES

3.1 For each Survey issued by Costa, there are 20 prizes in total to be won, one per winner. Each prize consists of one £50 electronic gift card redeemable towards the purchase of eligible products on www.amazon.co.uk (“Amazon Gift Card”).

3.2 Amazon Gift Cards are subject to Amazon EU S.à.r.l’s terms and conditions, please see https://www.amazon.co.uk/gp/help/customer/display.html%3FnodeId=200272910 for details of the terms and conditions which apply. As of 26 October 2023, Amazon Gift Cards expire ten years from the date of issuance and cannot be used to purchase other gift cards. Amazon Gift Cards cannot be reloaded, resold, transferred for value, used for unauthorised commercial purposes, including to facilitate the resale or shipment of goods from Amazon.co.uk, redeemed for cash, or used in a manner otherwise prohibited by the Amazon.co.uk Gift Cards Restrictions and Prohibited Activities policy. Unused Amazon Gift Card balances in an Amazon.co.uk account may not be transferred to another Amazon.co.uk account.

3.3 Each prize is non-transferable and cannot be resold. No cash or other alternative prize(s) will be provided in whole or in part, except that in the event of circumstances outside of Costa’s control which mean that Costa cannot award the prize described above, Costa reserves the right to substitute a similar prize or part of the prize of equal or greater value. Unless otherwise agreed in writing by Costa, a prize will only be awarded to a winner.

4. WINNERS

4.1 For each Survey issued by Costa, there will be a total of 20 winners selected at random from all eligible entries, using a randomised computer process.

4.2 Winners will be notified within 1 month of the date Costa’s initial email containing the link to a Survey is sent using the contact details provided and winners will be asked to confirm their details for delivery of the prize. Costa Club App members are encouraged to monitor their phone and/or email account during this time in case they are a winner.

4.3 In the event that a winner cannot be contacted within 4 weeks of the relevant draw or a prize is declined, Costa reserves the right to award the prize to an alternative winner selected at random.

4.4 A prize will be delivered to a winner by email to the email address provided within 10 days from a valid acceptance of the prize.

5. CONDITIONS

5.1 Each winner agrees to take part in reasonable publicity as may be required by Costa in respect of the promotion.

5.2 No entries from agents, third parties, syndicated entries or those made using methods such as a computer macro, script or the use of automated devices or bulk entries are permitted or accepted.

5.3 All costs and expenses not included within the prize and are the responsibility of the winner(s).

5.4 Costa reserves the right at any time, in its absolute discretion, to:

  • verify the eligibility of any participant (including their age and place of residence);

  • disqualify any participant found to be abusing or tampering with the operation of the promotion or entering/winning using fraudulent means, or who Costa believes to have acted in breach of these terms and conditions;

  • disqualify participants who do not give correct contact details, submit multiple entries, or those who make an entry, or create a Costa Club App account, on someone else's behalf; and

  • disqualify any participant that is, in Costa’s opinion, inappropriate, disrespectful, offensive or upsetting to other participants, fans of Costa or who acts contrary to applicable law and/or the UK Code of Non-broadcast Advertising, Sales Promotion and Direct Marketing (CAP Code).

6. LIABILITY

6.1 Subject to paragraph 6.2, if Costa fails to comply with these terms and conditions, it will be responsible for loss or damage participants suffer that is a foreseeable result of Costa’s breach of these terms and condition. Costa is not responsible for any loss or damage that is not foreseeable.

6.2 Costa shall not be liable for: (i) any failure to comply with these terms and conditions as a consequence of events beyond its reasonable control including without limitation, any failure of the internet or communication networks or of any other circumstances beyond the reasonable control of Costa including, but not limited to, any attempt to complete the Survey which is unsuccessful or incomplete, user error and any network, computer, hardware or software failures of any kind which may restrict, delay or prevent entry to the promotion; and/or (ii) any loss of profits, loss of revenue or other economic loss or any indirect or consequential loss.

6.3 Except as otherwise required by applicable law, Costa accepts no responsibility or liability for any entry or claim which for technical or other reasons is unsuccessful, incomplete, lost, late, damaged, corrupted or misdirected.

6.4 Neither Costa nor Amazon EU S.à.r.l are responsible if any Amazon Gift Card is lost, stolen, destroyed or used without a winner’s permission.

7. GENERAL

7.2 Costa reserves the right to extend, withdraw, alter or suspend the prizes or these terms and conditions at any time if circumstances beyond its control make this unavoidable.

7.3 Any images are an illustrative example and do not show the exact prize(s).

7.4 All personal data submitted in connection with the promotion will be processed on behalf of Costa by its agency Ommnisis for the purposes of administering and managing the promotion and prizes (where applicable) and verifying the eligibility of each participant. Costa is committed to protecting the privacy of all participants. Data that is collected from or about participants will be used in accordance with Costa’s Privacy Policy (which also includes information about the data rights of participants), a copy of which can be found at www.costa.co.uk/privacy-policy. You can request access to your personal data, or have any inaccuracies rectified, by getting in touch via our contact form. By participating in the promotion, you agree to the use of your personal data as described here.

7.5 Each winner gives Costa permission to publish their surname and county of residence to members of the public or regulators who request this information within 3 months of the closing date of this promotion. Winners have the right to request that their name not be published in the public domain, to do so they must notify Costa that they do not wish us to make these details available. Please note that Costa will nonetheless be required to provide the names of all prize winners to the Advertising Standards Authority if requested to do so.

7.6 If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.

7.7 The promotion and these terms and conditions, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with English law and you can bring legal proceedings in respect of the promotion and these terms and conditions in the English and Welsh courts. If you live in Scotland, you will also benefit from any mandatory provisions of Scottish law and can bring legal proceedings in respect of the promotion and these terms and conditions in either the Scottish or the English courts.
